Benjamin Wagner Charged with 2002 Sexual Assault of 14-Year-Old Girl

Prosecutor Kym Worthy has charged Benjamin Martin Wagner, 68, of Greenville, North Carolina, in connection with the sexual assault of a then 14-year-old girl. The victim is now 37 years old. A sexual assault kit was performed upon the victim at the time of the assault in 2002. This warrant was not ready to be processed in time for the defendant’s arraignment on the other cases on March 19, 2026.
On October 15, 2002, in the 15000 block of Trinity Street in Detroit, the victim was walking to catch the bus to school. It is alleged that Defendant Wagner approached the victim, pointed a handgun at her, ordered her from the scene, and sexually assaulted her. More complete facts and evidence will be placed on the record in court at the preliminary examination.
Benjamin Martin Wagner has been charged with one count of Kidnapping, two counts of First-Degree Criminal Sexual Conduct, and two counts of Third-Degree Criminal Sexual Conduct. *
“Our survivor in this case was only 14 years old when Benjamin Wagner allegedly kidnapped and sexually assaulted her. She is now 37 years old. She has lived with what happened to her for 23 years and has now bravely decided that she wants to be a part of holding him accountable,” said Prosecutor Kym Worthy.
He was arraigned and remanded to jail before Magistrate William Burton in 36th District Court. The Probable Cause Conference is on April 7, 2026, at 8:30 a.m. before Judge Shawn Jacque.
